Getting divorced is a life-changing moment and one which can be very upsetting and emotionally charged. We encourage family matters to be dealt with as amicably as possible.
The divorce itself can taken between four and six months. To obtain a divorce, a couple must have been married for one year or longer and you must show that the marriage has broken down irretrievably.
There are five ways to show this:-
Separation for two years with consent.
Separation for five years without consent.
The procedure is to issue an application for a divorce. This will be served on your partner, who must then file an Acknowledgement of Service.
Very few divorces are defended, so once the Acknowledgement of Service Form has been filed by your partner, the Court will approve the application, and in due course you can apply for the decree nisi. This is the first part of the formalisation of the divorce.
You can apply for the decree absolute, which brings your marriage to an end, six weeks and one day after the date of the decree nisi.
